Licensor reserves all rights and remedies available at law and in equity. The exercise of any one remedy does not preclude the exercise of any other.
Nothing in this Notice, on the ProForma Suite website, in any marketing or promotional material, or in any other communication from Licensor shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Works, trademarks, or other intellectual property of Licensor, except as expressly set forth in a written agreement executed by Licensor. The grant of a license to use the Software under the EULA does not convey any right to reproduce, distribute, publicly display, or create derivative works from the Software or any other Works.
"ProForma Suite," "DOCX Optimizer," "ProForm," "SynoptIQ," "QuizForge," and associated logos and product names are trademarks or common law marks of ProForma Suite. All other trademarks referenced herein are the property of their respective owners.
The Software may incorporate certain open-source or third-party components. Where such components are used, they are subject to their respective licenses, which do not in any way expand the rights granted to Licensee under the EULA with respect to the Software as a whole. The inclusion of open-source components does not make the Software open-source, and Licensee acquires no rights to any ProForma Suite proprietary code by virtue of the presence of such components. A list of third-party components and their applicable licenses is available in the Software's documentation folder.
If you believe that any ProForma Suite intellectual property is being infringed, or if you are aware of unauthorized distribution, cracking, or piracy of any ProForma Suite Software, please report it promptly. Licensor investigates all credible infringement reports and takes appropriate action.

ProForma Suite respects intellectual property rights and expects others to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and equivalent legislation in other jurisdictions (including the EU Copyright Directive and the UK Copyright, Designs and Patents Act 1988 as amended), Licensor will respond expeditiously to notices of alleged copyright infringement submitted in compliance with applicable law.
Counter-notifications from parties who believe their content was wrongly removed may also be submitted via the contact form, and will be processed in accordance with applicable law. Licensor reserves the right to terminate the licenses of users determined to be repeat infringers.

Tool-Only; No Data Provided or Retained. ProForma Suite provides a software tool exclusively. Licensor does not provide, supply, curate, validate, or take any responsibility for any data, content, or documents that users create or process using the Software. Licensor holds no copy of user data at any time, operates no cloud storage service, and performs no server-side processing of user content. All data created or handled through the Software resides solely on the user's local machine.
No Liability for Data Loss. Licensor expressly disclaims all liability for loss, corruption, or destruction of data of any kind arising from use of the Software. Users are solely responsible for maintaining independent backups of their data. Because Licensor retains no copy of user data, Licensor cannot recover lost data on a user's behalf under any circumstances.
Restricted Environments. Users are solely responsible for determining whether installation and use of the Software is permitted on their device, including compliance with employer IT policies, government IT security requirements, and applicable regulations. Licensor accepts no responsibility for consequences arising from installation or use of the Software in environments where such use is prohibited or requires prior approval.
